1. CONTEST PERIOD:
The Get Started 7 Day Challenge (the “Contest”) begins on Sunday, March 7th at 12:01 am Eastern Time (“ET”) and ends on Sunday, March 14th at 11:59 pm ET (the “Contest Period”). By participating in this Contest, you agree that you have read and understand these Official Rules and Regulations (the “Rules”) and agree to be bound by these Rules.
The Contest is open only to legal residents of Sudbury Ontario, and surrounding area, or North Bay Ontario, and surrounding area, who are eighteen (18) years of age or older at the time of entry, except employees, representatives or agents (and those with whom such persons are domiciled, whether related or not) of YMCA of Northeastern Ontario, a registered charity (the “Sponsor”), its parent companies, subsidiaries, affiliates, prize suppliers, dealers, advertising/promotion agencies and any other entity involved in the development, production, implementation, administration or fulfillment of the Contest (collectively, the “Contest Parties”).
3. HOW TO ENTER:
NO PURCHASE NECESSARY. To enter, go to www.ymcaneo.ca/get-started-7-day-challenge (the “Website”) and follow the on-screen instructions to obtain the Official Contest Entry Form (the “Entry Form”). Fully complete the Entry Form with all required information (which may require you to pass a CAPTCHA test). Once you have fully completed the Entry Form with all required information, follow the on-screen instructions to submit your fully completed Entry Form (an “Entry”). To be eligible, your Entry must be submitted and received in accordance with these Rules during the Contest Period (as determined by the Sponsor in its sole and absolute discretion on the basis of its official records).
There is a limit of one (1) Entry per person/email address during the Contest Period. For greater certainty and the avoidance of any doubt, you can only use one (1) email address to enter the Contest. If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) exceed any of the limits stated in the Rules; and/or (ii) use multiple names, identities, email addresses and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt this Contest; then he/she may be disqualified from the Contest in the sole and absolute discretion of the Sponsor. Your Entry may be rejected if (in the sole and absolute discretion of the Sponsor) the Entry Form is not fully completed with all required information and submitted and received in accordance with these Rules during the Contest Period. The Releasees (defined below) are not responsible for late, lost, misdirected, delayed, incomplete or incompatible Entries (all of which are void).
All Entries are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Entry or other information entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification in the sole and absolute discretion of the Sponsor. The sole determinant of the time for the purposes of this Contest will be the Contest server machine(s).
6. THE PRIZES:
There will be two (2) prize packs (the “Prizes”) available to be won, amounting to six (6) personal training sessions each to be redeemed at a YMCA of Northeastern Ontario location on or before December 31st at 11:59pm ET. Included in the prize packs is one (1) $25 Tim Hortons gift card and one (1) ceramic YMCA mug each. Total approximate retail value is $330 for each prize pack.
Participating YMCA of Northeastern Ontario Health, Fitness and Aquatics Centres include: Sudbury YMCA and North Bay YMCA. The personal training sessions are subject to all YMCA personal training terms and conditions available by contacting the YMCA.
Without limiting the foregoing, the following terms and conditions apply to the Prizes: a) the Prizes must be accepted as awarded and are not transferable, assignable or convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion); b) no substitutions except at Sponsor’s option; c) Sponsor reserves the right, in its sole and absolute discretion, to substitute any Prize or a component thereof with a prize of equal or greater retail value, including, without limitation, but at Sponsor’s sole and absolute discretion, a cash award; d) all characteristics and features of the Prizes (except as otherwise explicitly stated above) are at the Sponsor’s sole and absolute discretion; and e) all costs not expressly stated above as included in a Prize are the applicable winner’s sole responsibility.
7. SELECTION OF WINNERS:
There will be one (1) “Draw Date” for a total of two (2) winners. The “Draw Date” will be Monday, March 15th, 2021 between 9:00am ET and 5:00pm ET. (On the “Draw Date”), the Sponsor will perform two (2) random draws from among all eligible Entries received in accordance with these Rules during the Contest Period. On the “Draw Date” two (2) selected entrants will be deemed the potential Prize winner. The odds of winning a Prize depend on the number of eligible Entries received in accordance with these Rules during the Contest Period.
8. NOTIFICATION AND CONFIRMATION:
The winner will be sent an email and will have forty-eight hours to respond. If no response is received within forty-eight hours, another winner will be chosen. Administrators are not responsible for prize fulfillment nor for any technical failures. Winning entry will be verified. A list of winners will be displayed on Facebook and Instagram of the official YMCA of Northeastern Ontario pages and on the Mailchimp newsletter sent to all subscribers for the Get Started 7 Day Challenge.
Facebook, Instagram, and Twitter are in no way associated with this giveaway. If you sign up for newsletters as entries, you must confirm your subscription for those entries to count. A reply to the winning email is required within 48 hours before a new winner is chosen. The winner’s entries will be verified. Administrators and sponsors reserve the right to publish winner’s first name and last initial.
9. GENERAL CONDITIONS:
All Entries become the property of the Sponsor. This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries and/or entrants.
By entering, all contestants release and agree to hold harmless, YMCA of Northeastern Ontario, YMCA Canada, any company affiliated with such, any of their respective directors, officers, employees and agents of all such parties and any prize suppliers (collectively, the “RELEASED PARTIES”) from and against any and all liability for any injuries, damages to persons (including death), damages to personal property or any other loss whatsoever (collectively “LOSSES”) caused directly or indirectly, in whole or in part, by the contestant’s participation in the contest, including but not limited to Losses arising from: (a) the contestant’s acceptance, use or misuse of any prize awarded in the contest; (b) any act or omission made by any Released Party, third party (including any other Contestant) or the contestant himself / herself; (c) any latent or apparent defect or condition in any equipment used in the contest; (d) any previous medical condition of the contestant; (e) the administration of any first-aid, medical or emergency treatment or other services rendered to the contestant; and/or (f) the consumption of food or drink by the contestant.
In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: any website and/or point of sale, television, print or online advertising; the terms and conditions of these Rules shall prevail, govern and control to the fullest extent permitted by applicable law.
